DOAH’s Alternative Dispute Resolution (ADR) Program

DOAH has implemented an Alternative Dispute Resolution ("ADR") program. In an ADR case, a second Administrative Law Judge is assigned to the case as the "ADR Judge." A final hearing is set and the case proceeds on the typical procedural course, except that the ADR Judge invites the parties to participate in a settlement conference that the ADR Judge conducts by Zoom video conference well before the final hearing. The Zoom settlement conference is voluntary for all and there is no cost to participate. The parties are encouraged to discuss the dispute and narrow the issues, in hopes that the case may be resolved to the mutual benefit of the parties.

If the case is amicably resolved at the Zoom settlement conference, the ADR Judge issues a report so advising the Administrative Law Judge assigned to conduct the final hearing, and jurisdiction of the case is promptly relinquished to the agency. If the parties impasse, the case proceeds to final hearing as scheduled. The settlement conference is confidential, and the ADR Judge will not discuss the case with the Administrative Law Judge assigned to conduct the final hearing.

REGISTERED eALJ USERS

Effective immediately ALL orders issued by the Division will be transmitted to registered eALJ users in electronic format only. It is incumbent upon registered users to ensure their e-mail address is correct in eALJ. Non-registered parties will continue to receive orders in paper format.

The Division now provides eService of pleadings to parties registered with eALJ. eFilers may avail themselves of eService through the eALJ portal, or may do so through some other means.


CONFIDENTIAL INFORMATION

Every person filing a document at DOAH has the responsibility to ensure that no information protected by privacy or confidentiality laws is contained in any document that would be posted to DOAH's website in the regular course of business. This means that the person filing a document has the responsibility to redact (black out) or remove any protected private or confidential information, including but not limited to a social security number, from every document filed at DOAH.
