Surface Transportation Board Decisions (Nexis Uni) (1996+)
"The Surface Transportation Board (STB) was created on January 1, 1996, by Pub. L. 104-88, the ICC Termination Act of 1995. The Act abolished the Interstate Commerce Commission (ICC), transferred core rail and certain other functions to the STB, and transferred motor licensing and certain other motor functions to the Federal Highway Administration (FHA). The three-member STB is specifically responsible for the regulation of the rail and pipeline industries and certain non-licensing regulation of motor carriers and water carriers. The Board is empowered through its exemption authority to promote deregulation administratively, and continues the rail reforms of the Staggers Rail Act of 1980. The Board has jurisdiction over transportation by rail carrier that is by railroad or by railroad and water. The jurisdiction of the Board over transportation by rail carrier with respect to rates, classifications, rules, practices, routes, services, and carrier facilities is exclusive. The Board's regulatory oversight encompasses the regulation of rates, mergers, acquisitions, construction and abandonment of railroad lines, as well as the planning, analysis and policy development associated with these activities. The Board also has jurisdiction over transportation by pipeline, or by pipeline and railroad or water, when transporting a commodity other than water, gas or oil. The regulatory oversight of other surface transportation carriers includes certain regulation of the intercity bus industry and surface pipeline carriers as well as the rate regulation of water transportation in the non-contiguous domestic trade, household goods carriers, and collectively determined motor rates."
